New Law: Uninsured/Underinsured motorist auto insurance

Posted by: Neil Hillyard

Topic: auto accidents and insurance

Very often our clients suffer injuries in a auto, motor vehicle, or motorcycle accident and the other driver does not have adequate liability insurance to fully compensate the accident victim.  If the accident victim has purchased underinsured auto, motor vehicle, or motorcycle insurance coverage, he or she can receive additional compensation.

In January 2008 the legislature strengthened this added protection.  If the driver at fault in an auto accident or motorcycle accident only has, an an example, $25,000 liability insurance and the auto accident or motorcycle accident victim has purchased $100,000 underinsured (UIM) coverage, the victim can receive the $25,000 plus the $100,000 under his UIM policy.

Underinsured motorist coverage (UMI) is relatively inexpensive coverage for auto, motor vehicle or motorcycle use.  If you are in an accident involving one of these, this insurance coverage can be very important to you.

This new law only applies to insurance policies purchased after January 1, 2008.  It would be wise to consult with your auto, motor vehicle, or motorcycle insurance agent even if your policy does not expire soon.
